1. Scope of this EULA
This End User License Agreement ("EULA") is a legal agreement between you and ApeXhit LLC governing your installation and use of the apexhit.org Progressive Web App (the "App") — the installable shell of https://apexhit.org, including its offline caching shell, icons, and manifest. It does not replace or supersede the individual EULA or terms of any separate ApeXhit application (POS Master/Agent/Founder, the Financial Health Budget app, the Digital Business Card app, LinkIt, or any other app in our directory), each of which has its own license terms presented at first use of that application.
By installing the App to your device's home screen or app list, or by continuing to use it, you agree to be bound by this EULA. If you do not agree, uninstall the App and discontinue use.
2. License grant
Subject to your compliance with this EULA and our Terms of Service, ApeXhit LLC grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and run the App on devices you own or control, solely for your personal or internal business use in viewing and interacting with the ApeXhit website, app directory, and showcase.
3. Restrictions
You agree that you will not, and will not permit any third party to:
- Copy, modify, translate, or create derivative works of the App;
- Reverse engineer, decompile, or disassemble the App, except to the extent such restriction is prohibited by applicable law;
- Sell, rent, lease, sublicense, distribute, or otherwise transfer the App or any rights granted herein to any third party;
- Remove, obscure, or alter any proprietary notices (including the ApeXhit name and cyborg logo) on the App;
- Use the App in any manner that could damage, disable, overburden, or impair it, or interfere with any other party's use of it.
4. Ownership
The App is licensed, not sold. ApeXhit LLC and its licensors retain all right, title, and interest in and to the App, including all intellectual property rights therein. No rights are granted to you other than the limited license expressly set out in Section 2.
5. Updates
The App may periodically download and install updates automatically via its service worker to keep content and functionality current. You agree that this EULA will apply to all such updates unless a separate license is provided with the update.
6. Third-party components
The App is built using open-source and third-party software libraries (including, without limitation, Next.js and React and their respective dependencies), each governed by its own license. Nothing in this EULA limits any rights granted to you under those open-source licenses.
7. No warranty
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
8. Limitation of liability
To the maximum extent permitted by law, our aggregate liability arising out of or related to this EULA or the App shall not exceed one hundred U.S. dollars (US$100), and in no event shall we be liable for any indirect, incidental, or consequential damages.
9. Term & termination
This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any of its terms, or if you uninstall the App. Upon termination, you must cease all use of the App and remove it from your device(s).
10. Export compliance
You agree to comply with all applicable export and re-export control laws and regulations in your use of the App.
11. Governing law
This EULA is governed by the laws of the State of Florida, without regard to conflict-of-law principles, consistent with Section 13 of our Terms of Service.
